Work permit to Ukraine


According to the law of Ukraine, foreigners and stateless persons are officially prohibited from working on the territory of Ukraine without obtaining a work permit from the competent authorities of Ukraine. The exception is:

  • Foreign citizens who have a permanent residence permit in Ukraine;
  • Foreigners who have received refugee status in Ukraine;
  • Representatives of foreign sea (river) and airlines;
  • Stateless persons designated by the executive body;
  • Journalists accredited in Ukraine;
  • Athletes, artists;
  • Rescuers to perform urgent work;
  • Employees of foreign missions;
  • Priests;
  • Participants in international technical assistance projects who have come for teaching or research activities.

Salary for foreigners. For employment of foreign citizens in Ukraine who hold ordinary specialties (not included in the list), salary accounting and payment is mandatory in the amount of 10 minimum wages (10 * 6000 = 60 000 UAH as of 01.02.2021). As a general rule, the term of employment of such specialties is not more than 1 year. After the permit expires, it is possibile to extend it. For this, it is necessary to prepare a package of documents to extend the validity of the permit for employment in Ukraine. The permit for employment is issued by the local authority of the employment center. The term for issuing the permit for employment is 7 working days.

The list of exceptions , which are not covered by the requirements of increased wages, as well as which have the opportunity to obtain a work permit for up to 3 years is possible for:

  • Founders of companies;
  • Foreign highly paid professionals (with apostilized / legalized diploma);
  • University graduates who are included in the ranking of the top 100 universities in the world;
  • Representatives of creative professions (confirmation is the presence of a document confirming the existence of a patent or copyright);
  • foreign IT professionals.

Within 30 days it is necessary to make a change in the work permit in the event of one of the following events:

  • Change of data in the company (name change, reorganization, etc.);
  • Registration of a new passport of a foreigner;
  • Change of position or transfer to another position of a foreigner.

The work permit can be extended an unlimited number of times, the application must be submitted no later than 20 days before its expiration.

The issuance of a work permit may be denied for the following reasons:

  • Inconsistency of data in the submitted documents, as well as the presence of comments that have not been eliminated;
  • Violation of submission deadlines;
  • Entry in the state register of liquidation of the company.

Cases provided by the legislation of Ukraine in which the work permit of a foreigner or a stateless person may be revoked:

  • Change of data in the company (name change, reorganization, etc.);
  • Registration of a new passport of a foreigner;
  • Change of position or transfer to another position of a foreigner.

The work permit can be revoked:

  • Termination of employment contract;
  • Obtaining refugee status;
  • No official payment for a work permit;
  • Failure to submit an employment contract;
  • Company letter on revocation of employment permit;
  • Detection of inaccurate data;
  • Existence of a decision on forced deportations;
  • Work on conditions other than those provided for in the employment contract;
  • Failure to report;
  • Violation of terms of stay on the territory of Ukraine.
